Agreement and provider
These terms apply to the BirdHere app, website and related support provided by Eutopix Labs Prosta Spółka Akcyjna (P.S.A.), ul. Hoża 86/410, 00-682 Warszawa, Poland, KRS 0001237465, VAT PL7011310736.
By downloading or using BirdHere, you agree to these terms and Apple’s Standard Licensed Application End User License Agreement. If they conflict, mandatory law and Apple’s terms control where applicable.
Personal and lawful use
BirdHere is licensed for lawful personal and educational reference use. You are responsible for respecting wildlife, protected areas, private property, recording and consent laws, and rules that apply where you use the app. Do not disturb, lure, harass or endanger birds to obtain a recording or photograph.
Identification is uncertain
BirdHere uses statistical models. A result can be incomplete, unavailable or wrong because of noise, distance, mimicry, overlapping species, geography, season, missing training data or model limitations. Confidence-like values are comparative signals, not calibrated scientific probabilities.
Do not rely on BirdHere for navigation, emergency decisions, wildlife enforcement, protected-species handling, environmental assessment or any decision where an error could cause harm. Confirm important observations with qualified experts and independent evidence.
Availability and model downloads
Core features depend on compatible iOS hardware and installed model packs. Regions, species coverage, model size and external sources may change as the product improves or upstream providers evolve. We do not guarantee that every species, device, place or recording environment will produce a result.
Downloaded packs must pass integrity checks. You may not bypass, tamper with or redistribute protected app components except where an included open-source license expressly permits it.
Free features and World Pass
The free tier includes unlimited short identifications, one home region, the worldwide guide and a basic journal. World Pass is intended as a one-time non-consumable purchase that unlocks Live Listen, imports, ranked alternatives, saved audio/export, travel regions and the worldwide fallback.
Available features and the exact localized price are shown in the app before purchase. Apple handles billing, taxes, family sharing eligibility, receipts and refunds. Use Restore Purchases with the Apple Account that made the purchase.
Photos, names and third-party content
BirdHere may display common and scientific names derived from licensed taxonomies and, after an explicit request, community media from iNaturalist. Creator, source and license attribution accompanies eligible media. Rights remain with their respective owners. External sites have their own terms and privacy practices.
Referenced projects and contributors do not sponsor or endorse BirdHere. Required source, license, and attribution notices are available in the app’s acknowledgements.
Your exports
You control journal entries, notes and recordings you create. You are responsible for deciding whether and with whom to share exported material, especially when it reveals voices, private places or sensitive species locations.
Changes and discontinuation
We may fix, improve, replace or discontinue features and external integrations while respecting applicable purchase rights and legal obligations. We may update these terms; the effective date will be shown above.
Disclaimers and liability
To the maximum extent permitted by law, BirdHere is provided “as is” without a guarantee of uninterrupted availability or identification accuracy. Nothing in these terms excludes rights or liability that cannot legally be excluded, including mandatory consumer protections.
Governing law
Polish law applies without depriving consumers of mandatory protections in their country of residence. Courts are determined by applicable law.
